Abstract

In this study we explore Marx's Critique of Hegel's Law Philosophy. The goal is to analyze the philosophical aspects that guide such criticism, and at the same time present the writings of the young Marx and commentators on the criticism of the concept of State in Hegel. By studying Marx´s criticism on Hegel, we argue, it is essential to present the issue on the philosophical positions between them. This was concretely done in the issues concerning the State. Unlike Hegel, for whom the development of philosophy was only logical, for Marx it was in history that theoretical practice found its place. In this neuralgic point it claimed the distance Marx kept in his research that the history of philosophy carried out by Hegel. Our main aim is to analyze the work by Marx, entitled "Critique of Hegel's Philosophy of Law" within § 261 to the § 271. We seek to establish essential points that will reflect the Marx´s ideas, reflecting his critical positions to Hegel. Hegel´s attempt was to lead to the reason the possibility of realization of freedom in the context of the State organization on the family and civil society. However, the notion of State in Marx shows that the human rights of workers must be considered, paying attention to the conditions of the means of production sustained by the economy.
