Abstract

The principle of the dignity of the human person, embodied in various constitutions of Western countries, has served as the main basis for judicial decisions aimed at implementing fundamental rights in kind, even if not expressly provided by the corresponding legislation.As shown by the lessons of the German philosopher Jürgen Habermas, this operation must be done, at the most, with due parsimony, under penalty of outraging the postulates of a secularized modern State.
